The Court in Sierra Leone, presided over by Magistrate Mark Ngegba, has approved a petition put forth by legal representatives acting on behalf of the National Social Security and Insurance Trust (NASSIT). This petition seeks the apprehension of Philip Turay, the Proprietor, and the Financial Manager of the National Conservation Trust Fund. The reason for this request stems from their failure to meet the NASSIT contribution obligations for their workforce.
The attorneys representing the National Social Security and Insurance Trust (NASSIT) presented this request before Magistrate Marke Ngegba, who was overseeing the NASSIT Court during the recent weekend.
The individuals facing legal action are Martin Foday, the Proprietor of the National Conservation Trust Fund, and Philip Turay, serving as the Financial Manager. They are charged with an offence related to their failure to fulfill Social Security Contribution requirements, a violation of the law.
The accused parties, namely the National Conservation Trust Fund, Martin A. Foday, and Philip Turay, function as an institution and employer respectively under the National Social Security and Insurance Trust Act No. 5 of 2001. The period between February 2017 and May 2017 saw them allegedly neglect their responsibility to remit Social Security Contributions amounting to nineteen thousand seven hundred and thirteen Leones and fifty-seven cents (Le 19,713.57) in the new Leones currency on behalf of their employees. This neglect occurred at their location, No. 4-6 FA John Avenue, Congo Town, Freetown.
The enforcement of the warrant is set for the 2nd of September 2023, when the case is scheduled to be revisited.
