Flawed Reasons Behind Banning Street: A Critical Analysis of the Issue




Legal Link, a Christian Lawyers Centre, has argued that a proposed ban on street rallies as a campaign tool may be wrong, illegal, exaggerated, and misplaced. In an Advisory Opinion issued on April 4, 2023, Legal Link provided 10 reasons to support its stance, citing that the ban would violate fundamental human rights guaranteed under the 1991 Constitution of Sierra Leone, including the right to freedom of movement and the right to freedom of assembly and association. Legal Link also argued that the proposed ban would undermine political participation and enthusiasm, conflict with Sierra Leone’s human rights obligations under international law, instill fear and panic before, during, and after elections, and allow for complacency within the security architecture. Additionally, Legal Link stated that such bans are typically void of due process, make room for political apathy, and are inconsistent with the spirit and object of the 1991 Constitution, particularly when illegal measures are proposed to restrict fundamental human rights.
